The US Supreme Court said it will hear an appeal that could overturn hundreds of charges brought in connection with the January 2021 attack on the Capitol, including against former President Donald Trump.
The judges will consider charges of obstruction of an official process, which have been brought against more than 300 people.
The charge arises from an attempt to disrupt Congress’ certification of Joe Biden’s victory over Trump in the 2020 election.
This is one of four charges brought against Trump in the case led by special prosecutor Jack Smith. He accused Trump of conspiring to overturn his election loss. Trump is also charged with conspiring to obstruct an official proceeding.
The court’s decision to intervene in the obstruction charge could jeopardize the start of Trump’s trial, scheduled for March 4.
The justices will separately consider whether it is advisable to rule quickly on Trump’s claim that he cannot be held accountable for actions committed as president. A federal judge rejected that argument.
